As a Senior Executive, the incumbent provides legal advice and staff assistance to the Assistant Attorney General on the range of constitutional and statutory issues that come before the Office from senior Department leaders, other components of the Department, other executive agencies and the White House Counsel's Office. In particular, the incumbent helps supervise and manage the Office's work related to congressional oversight and executive privilege.

As a Senior Executive, the Special Counsel provides legal advice and staff assistance to the Assistant Attorney General and has responsibility for handling a number of matters of ongoing concern to the Office, as well as special projects, subject to the general direction of the Assistant Attorney General. More specifically the Special Counsel: Prepares and supervises the preparation of legal advice, including written legal opinions for the signature of the Assistant Attorney General and oral legal advice as requested by and under the direction of the Assistant Attorney General. Participates in the supervision and management of the Office's practice involving congressional oversight and executive privilege, which includes providing counseling on these topics to the White House Counsel's Office, senior leadership of the Department, and agency general counsels, as well as participating in the preparation of the Office's formal written legal advice on these topics. Participates in the supervision and management of the Office's counseling practice involving Freedom of Information Act ("FOIA") issues, as well the Office's response to FOIA requests to the Office. Assists the Assistant Attorney General in supervising the Office's counseling function in additional areas of the Office's work as assigned by the Assistant Attorney General. Advises the Assistant Attorney General as requested on matters in the area of Office administration, including such matters as attorney recruitment, the Office budget, and long-range planning. Assists the Assistant Attorney General on special projects as requested. Provides supervisory assistance to Attorney-Advisors and reviews their written work, as assigned by the Assistant Attorney General. Represents the Office at meetings within and outside the Department.

Applications without separate narrative statements will not be considered. Note: You do not need to address the ECQs if you: 1) are currently serving under a career SES appointment; 2) are eligible for reinstatement into the SES; or 3) have successfully completed a SES Candidate Development Program and have been certified by Office of Personnel Management (OPM). Proof of Qualifications Review Board (QRB) certification must be provided in your application or SF-50 as applicable. Please refer to the required documentation section below for additional information. The ECQs measure whether an individual has the broad executive skills needed to succeed in a variety of SES positions. All applicants must submit a written narrative to address the ECQs. Your narrative must address each ECQ separately and should contain one or two examples per ECQ describing your experiences and accomplishments/results. The narrative should be clear, concise, and emphasize your level of responsibility, scope and complexity of programs managed, program accomplishments, policy initiatives undertaken and the results of your actions. You should not enter "Refer to Resume" to describe your experiences. Applications directing the reviewer to search within the application or to see the resume are considered incomplete and may not receive further consideration. The narrative must not exceed 10 pages. There are five ECQs: ECQ1 - LEADING CHANGE: This core qualification involves the ability to bring about strategic change, both within and outside the organization, to meet organizational goals. Inherent to this ECQ is the ability to establish an organizational vision and to implement it in a continuously changing environment. ECQ2 - LEADING PEOPLE: This core qualification involves the ability to lead people toward meeting the organization's vision, mission, and goals. Inherent to this ECQ is the ability to provide an inclusive workplace that fosters the development of others, facilitates cooperation and teamwork, and supports constructive resolution of conflicts. ECQ3 - RESULTS DRIVEN: This core qualification involves the ability to meet organizational goals. Inherent to this ECQ is the ability to make decisions that produce high-quality results by applying technical knowledge, analyzing problems, and calculating risks. ECQ4 - BUSINESS ACUMEN: This core qualification involves the ability to manage human, financial, and information resources strategically. ECQ5 - BUILDING COALITIONS: This core qualification involves the ability to build coalitions internally and with other Federal agencies, State and local governments, nonprofit and private sector organizations, foreign governments, or international organizations to achieve common goals. Mandatory Technical Qualifications (MTQ) You must address the MTQs as separate narrative statements not to exceed two (2) pages per MTQ. We recommend that your application emphasize your level of responsibilities, the scope and complexity of the programs managed, and your program accomplishments, including the results of your actions. You will be evaluated to determine if you meet the minimum qualifications required of the position and on the extent your application demonstrates that you possess the knowledge, skills, and abilities required of the Special Counsel. Please be sure to give concrete examples of your experience and demonstrate the complexity of the knowledge you possess. There are two MTQs for this position, they are: MTQ 1: Demonstrated experience in interpreting constitutional provisions, federal statutes, and regulations, including preparing or supervising the preparation of written legal opinions and advice. MTQ 2: Demonstrated experience in providing legal advice in the area of congressional oversight and executive privilege.

Education

Applicants must possess a J.D. degree from a law school accredited by the American Bar Association, have at least 5 years of relevant post-J.D. experience, and be an active member of the bar in good standing in a state, U.S. territory, the District of Columbia, or the Commonwealth of Puerto Rico.
